Federal Circuit Clears ISPs In Patent Dispute

Law360, New York (February 20, 2007, 12:00 AM EST) -- A federal appeals court affirmed on Tuesday a ruling from the Eastern District of Texas that cleared EarthLink Inc. and a handful of its rivals of infringing a patent holding company’s intellectual property.

The lawsuit, filed by MyMail Ltd. in April 2004, accused eight ISPs of infringing U.S. Patent Number 6,571,290. But the often plaintiff-friendly federal court in Texas granted EarthLink’s motion for summary judgment of non-infringement in November 2005.
