Arrowood Win Upheld In Pollution Indemnification Suit

Law360, New York (August 24, 2010, 1:43 PM EDT) -- A federal appeals court has ruled that a lower court correctly held that a pollution exclusion in Arrowood Indemnity Co.'s policy barred Hussey Copper Ltd.'s indemnification bid for a lawsuit over the contamination of a retention pond.

The U.S. Court of Appeals for the Third Circuit on Monday affirmed a judgment in Arrowood's favor, ruling that Hussey's liability in the underlying lawsuit was outside the scope of the policy under which it sought coverage.
