Couple Wins $1.5M Verdict In Hernia Patch Bellwether
Law360 (August 24, 2010, 2:06 PM EDT) -- A jury has awarded $1.5 million to a North Carolina couple injured by allegedly defective hernia patches, but won't get the chance to impose punitive damages, according to a federal judge overseeing multidistrict litigation against C.R. Bard Inc. and a subsidiary.
Christopher Thorpe won $1.3 million Monday in the second of four bellwether trials in the U.S. District Court for the District of Rhode Island, with wife Laure Thorpe taking home $200,000 for loss of consortium. The couple had claimed that Bard's Composix Kugel surgical mesh patches were unreasonably designed and carried inadequate warning of risk.
