Patent Damages In 2010 And Beyond

Law360, New York (August 31, 2010, 6:13 PM EDT) -- Damages awards in patent cases are a hot topic and a contentious issue in the patent reform debate. While congressional action remains uncertain, courts are focusing more than ever before on how to calculate reasonable royalty damages in patent cases.

Litigants should play close attention to the methodologies used to calculate damages, whether existing patent licenses are sufficiently similar to the patented invention at issue in the case, and whether the amount of damages is reasonable and supported by the evidence.
