AISLIC Prevails In Toxic Gas Coverage Dispute

Law360, New York (August 25, 2010, 2:46 PM EDT) -- A federal appeals court has affirmed summary judgment for American International Specialty Lines Insurance Co. in an insurance coverage dispute with DPC Industries Inc. relating to a release of toxic chlorine gas from a plant.

AISLIC is not obligated to provide the more valuable “Coverage A” to DPC under the policy at issue because it already provided a lower-level “Coverage D-2” to the company for the same events, a three-judge panel in the U.S. Court of Appeals for the Fifth Circuit ruled Tuesday.
