Software Tree IP Claims Survive Red Hat Dismissal Bid

Law360, New York (August 27, 2010, 1:16 PM EDT) -- A federal judge has tossed Red Hat Inc.'s bid for summary judgment on several claims brought by Software Tree LLC in an infringement suit against a number of technology companies over a patent related to a Java-based application server.

Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas on Thursday affirmed a report by a magistrate judge that recommended the dismissal of Red Hat's motion for partial summary judgment.
