Green Groups Ask To Join Texas Air Quality Fight

Law360, New York (August 31, 2010, 1:53 PM EDT) -- Two environmental groups have asked to intervene as defendants in an appeal of the U.S. Environmental Protection Agency's rejection of a Texas permitting program designed to allow companies to lump pollution from multiple sources under one cap.

The Environmental Defense Fund and the Environmental Integrity Project said in a motion filed Thursday in the U.S. Court of Appeals for the Fifth Circuit that they should be allowed to intervene in the suit because they play a role in developing the state's Clean Air Act implementation plan....
