ClearOne Wins Fee Fight With Ex-CEO In 10th Circ.

Law360, New York (August 31, 2010, 2:41 PM EDT) -- A federal appeals court has revoked an order requiring ClearOne Communications Inc. to pay the defense costs of former CEO Frances Flood, who accused the company of breaching a separation agreement and was recently convicted of securities violations.

The U.S. Court of Appeals for the Tenth Circuit issued the ruling Monday, saying the agreement requires certain conditions to be met before ClearOne must pay Flood's defense costs. The district court erroneously concluded that ClearOne's promise had virtually no conditions, the appeals court said.
