Law360 (September 13, 2010, 10:35 AM EDT) -- More than a year ago in an article for this publication, I exhorted business owners and inventors to protect their intellectual property due to, not in spite of, the depressed economy. My suggestion still stands, however, the passage of time begs this question: Is private intellectual property — patents in particular — incompatible with current policies that trend toward such things as "redistribution of wealth" and "universal health care?"[1] Stated another way: Is a patent worth the significant time and money investments required if patents are treated with de facto hostility by U.S. economic policies?...
