LandCoast Still On Hook For Scaffolding Collapse

Law360, New York (September 2, 2010, 1:59 PM EDT) -- Subcontractor LandCoast Insulation Inc. has lost its bid to escape an obligation to indemnify contractor PIC Group Inc. for a 2008 scaffolding collapse at a Mississippi power plant that injured six people and killed a LandCoast employee.

Judge Keith Starrett of the U.S. District Court for the Southern District of Mississippi on Wednesday rejected LandCoast's partial summary judgment motion seeking a declaratory ruling that the indemnity provision in the parties' subcontractor agreement was void and unenforceable under applicable state law.
