Magistrate Judge OKs Rate-Change Suit Against Liberty

Law360, New York (September 3, 2010, 3:49 PM EDT) -- A magistrate judge has recommended that a federal court allow a suit to proceed that accuses Liberty Mutual Insurance Co. of overcharging workers' compensation insurance policyholder Roush Fenway Services LLC, a race car owner, by $2.4 million.

Liberty has asked the U.S. District Court for the Middle District of North Carolina to dismiss the action, saying rates in North Carolina, where Roush does business, are strictly governed by state regulators and cannot be challenged.
