Harley Wants Antitrust, Tort Claims Nixed In Bag Suit

Law360, New York (September 3, 2010, 2:11 PM EDT) -- Harley-Davidson Inc. has asked a judge to drop antitrust and tort claims from a suit lodged by Packaging Supplies Inc. accusing the motorcycle stalwart of tying motorcycle sales at independent dealerships to the purchase of Harley merchandise bags.

Harley’s decision to bar motorcycle dealers from using third-party merchandise bags bearing the company’s logos can’t be condemned as an antitrust violation or improper interference with PSI’s business because Harley was protecting its trademarks, Harley told Judge Robert Dow of the U.S. District Court for the Northern District...
