9th Circ. Says It Lacks Reach To Hear Appeal Of Remand

Law360, New York (September 3, 2010, 1:27 PM EDT) -- A federal appeals court has upheld an order remanding a suit against Mt. Hawley Insurance Co. over $10 million in property damage to state court, saying it lacks the jurisdiction to hear the appeal.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit on Thursday ruled that it cannot hear the case because the legality of remand orders can be taken up by appellate courts only in limited circumstances.
