Importer KYD Denied Unique Duty Margin On Thai Bags

Law360, New York (September 3, 2010, 4:54 PM EDT) -- The U.S. Department of Commerce on remand has stuck to its refusal to grant Hawaiian importer KYD Inc. a unique duty rate on carrier bag imports from Thailand, saying the request is not provided for by law.

No provision of the Tariff Act of 1930 so much as contemplates the possibility of individual duty rates for importers, Commerce said Wednesday in results submitted in the U.S. Court of International Trade.
