Enviro Denied Quick Win In PG&E Water Pollution Spat

Law360, New York (September 9, 2010, 6:11 PM EDT) -- A federal judge has denied an environmental group's motion for summary judgment that Pacific Gas & Electric Co. violated the Clean Water Act at two facilities, in a case alleging environmental breaches at more than 30 sites in Northern California.

Judge Richard Seeborg of the U.S. District Court for the Northern District of California on Tuesday denied the Ecological Rights Foundation's Aug. 3 motion for partial summary judgment, which sought a ruling that PG&E was liable for discharging pollutants without a permit at two facilities....
