US Cos. Lose Vietnamese Shrimp Suit On Appeal

Law360, New York (September 9, 2010, 5:01 PM EDT) -- A federal appeals court has determined that the U.S. Court of International Trade was wrong to toss U.S. shrimp producers' suit challenging the review of an anti-dumping duty order on frozen warmwater shrimp from Vietnam without reaching the merits, remanding the case for judgment against the coalition.

The U.S. Court of Appeals for the Federal Circuit on Wednesday determined that enough evidence supported the U.S. Department of Commerce’s final results assigning an anti-dumping margin of zero to Vietnam Fish One Co. Ltd. in the administrative review....
