Briefs Pile Up In Cat's Paw Case As Kagan Recuses

Law360, New York (September 9, 2010, 2:54 PM EDT) -- Associate Justice Elena Kagan has recused herself from a closely watched case concerning whether employers can be held liable for unlawful discrimination by an official other than the primary decision-maker.

The National School Boards Association filed an amicus brief with the U.S. Supreme Court support of Proctor Hospital on Tuesday, the same day that Justice Kagan, who had recommended that the high court take the case when she was solicitor general, was recused from the cat’s paw fight.
