7th Circ. Revives Bemis Retirees' ERISA Class Action

Law360, New York (September 13, 2010, 6:53 PM EDT) -- A federal appeals court has breathed new life into a class action alleging packaging company Bemis Co. Inc. breached a plant-closing deal and violated the Employment Retirement Income Security Act by reducing health benefits under a medical plan for a group of retirees.

The parties’ agreement was to provide lifetime benefits to retirees, a three-judge panel ruled in the U.S. Court of Appeals for the Seventh Circuit on Monday.
