CIT Affirms Countervailing Duties On Essar Steel

Law360, New York (September 14, 2010, 4:26 PM EDT) -- The U.S. Court of International Trade has sustained the Department of Commerce’s remand ruling that Essar Steel Ltd. received an ad valorem Indian government subsidy of 23.64 percent on certain hot-rolled carbon steel flat products — a higher subsidy than previously determined.

Judge Judith Barzilay on Monday shot down arguments by Essar and U.S. Steel Corp. challenging parts of the July 15 determination, and dismissed their consolidated case that took issue with Commerce's subsidy ruling on steel products imported in 2006.
