Medmarc Moves To Nix Policy For Disbarred Attorney

Law360, New York (September 14, 2010, 5:49 PM EDT) -- Medmarc Casualty Insurance Co. has asked a court for the second time to grant summary judgment in a suit seeking to rescind a policy issued to a real estate lawyer who admitted concealing a mortgage fraud scheme.

Jerome D. Mitchell, now disbarred, was a "walking malpractice claim" when he applied for a policy under Medmarc's preferred lawyer program in October 2007, entitling Medmarc to rescind the policy, the insurer said in a motion Monday in the U.S. District Court for the Middle District of Florida....
