CERCLA Deal Can't Shield Sherwin-Williams: 9th Circ.

Law360 (September 16, 2010, 5:51 PM EDT) -- A federal appeals court has upheld a ruling that the contribution bar in a 2001 settlement between Sherwin-Williams Co. and the city of Emeryville, Calif., does not protect the company against cross-claims filed by a group of intervenor property owners in a state court action.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit on Wednesday struck down Sherwin-Williams’ appeal of the district court’s order granting in part and denying in part a motion for declaratory and injunctive relief.
