5th Circ. Leaves Celanese On Hook For $4.6M Cleanup

Law360, New York (September 21, 2010, 6:11 PM EDT) -- A federal appeals court has upheld a lower court ruling that a contractor that damaged a methanol pipeline 30 years ago is not responsible for any of the $4.6 million spent by the pipeline's owner to clean up the resulting contamination, dealing a blow to Celanese Corp. in its bid to recover costs.

The U.S. Court of Appeals for the Fifth Circuit on Monday found that Celanese could not get its money back, even though the leaking pipe was damaged by Martin K. Eby Construction Co....
