FDA Denies Greenlighting J&J 'Phantom' Recall

Law360, New York (September 21, 2010, 3:59 PM EDT) -- The U.S. Food and Drug Administration has denied news reports claiming it knew about an alleged Johnson & Johnson Services Inc. plan in 2008 to enlist contractors to buy defective Motrin from stores rather than formally recall the painkiller.

Employees at J&J's McNeil Consumer Healthcare unit sent each other messages in March and April 2009 saying they had kept an FDA official apprised of the company's so-called phantom recall, the Wall Street Journal reported Tuesday, citing e-mails and letters the newspaper had reviewed.
