Roche Gets Suit Over Diagnostic Testing Patent Nixed

Law360, New York (September 21, 2010, 1:06 PM EDT) -- Roche Diagnostics Corp. has shaken off Polymer Technology Systems Inc.'s claim of patent invalidity in a declaratory judgment suit over diagnostic testing meter technology, while a federal judge has sent the remaining noninfringement claim to arbitration.

Judge Larry J. McKinney of the U.S. District Court for the Southern District of Indiana on Monday granted Roche's motion to dismiss the invalidity claim and to compel arbitration on the remaining noninfringement issue pursuant to a previously executed license agreement.
