Judge Increases Damages In Masimo's Patent Suit Vs. Tyco Unit

Law360, New York (August 12, 2004, 12:00 AM EDT) -- A federal judge has ordered Tyco International Ltd.'s Nellcor unit to pay Masimo Corp. an additional $29.6 million for infringing a patent for machines that measure the oxygen content in blood.

Judge Mariana Pfaelzer of the U.S. District Court for the Central District of California increased the damages to a total of $164 million to cover Nellcor's infringement from Jan. 1 to May 31.

A jury in March determined that Nellcor infringed the patent used in pulse oximetry machines that measure blood-oxygen levels.
