N.C. Governor Violated U.S. Constitution: Judge

Law360 (February 28, 2007, 12:00 AM EST) -- A Superior Court judge has ruled that North Carolina Gov. Mike Easley violated the U.S. Constitution when he diverted $130 million in state pension funds to help reduce a budget deficit.

The decision, which was handed down Friday by Judge Joseph R. John Sr., came about a half year after he similarly ruled that Easley had violated the state constitution.

“Defendants have failed to carry their burden of proving that the diversion of employer contributions was ‘reasonable’ or ‘necessary’ in service of that purpose,” he wrote....
