Whistleblower Suits Over Children's Drugs Tossed

Law360, New York (September 27, 2010, 6:39 PM EDT) -- A federal court has dismissed two False Claims Act suits brought by anti-psychiatry advocates who claim that doctors and pharmacies defrauded Medicaid by submitting claims for psychiatric drugs prescribed to children off-label.

The conduct described in the complaints is known to the federal government, so “the public disclosure bar” limiting who can file a whistleblower suits applies, Judge Timothy Burgess of the U.S. District Court for the District of Alaska ruled Friday.
