Insurer Wants NJ County Sanctioned Over Lost E-Mails

Law360, New York (September 27, 2010, 6:24 PM EDT) -- An insurance company is seeking court sanctions against a New Jersey county it says failed to preserve potentially damaging communications in litigation over a $10 million claim from a motor vehicle crash.

State National Insurance Company Inc. said in a motion Friday in the U.S. District Court for the District of New Jersey that Camden County failed to disable an automatic e-mail deletion system when it was expecting litigation over its demand that the insurer pay the full policy limit to settle the underlying negligence case....
