Hospital Network Gets OT Class Action Tossed

Law360, New York (September 28, 2010, 3:08 PM EDT) -- A judge has dismissed a proposed class action alleging Caritas Christi Health Care hospital network deprived employees of wages due for training and work completed off the clock and during meal breaks, saying the claims are preempted by federal law.

Judge George A. O'Toole Jr. of the U.S. District Court for the District of Massachusetts said Monday that the claims alleged by Ashleigh Pruell and Amy Gordon were preempted by the Labor Management Relations Act because they arise from collective bargaining agreements.
