Fry's Exec Loses Bid To Toss $65M Kickback Charge

Law360, New York (September 29, 2010, 12:47 PM EDT) -- A federal judge has refused to dismiss an indictment accusing a former Fry’s Electronics Inc. merchandising executive of pocketing $65 million in kickbacks from vendors.

On Tuesday, Judge Jeremy Fogel of the U.S. District Court for the Northern District of California brushed aside Ausaf Umar Siddiqui’s contention that the indictment is fatally deficient because the wire fraud statute is unconstitutionally vague regarding conduct covered by the honest services provision.
