Monsanto Loses Bid To Link Investor, Derivative Suits

Law360, New York (September 30, 2010, 1:33 PM EDT) -- A federal judge has refused to consolidate a derivative shareholder suit against Monsanto Co.'s officers and directors with a putative securities class action against the pesticide giant, both of which relate to declining demand for the herbicide Roundup.

Judge Catherine D. Perry of the U.S. District Court for the Eastern District of Missouri ruled Tuesday that consolidation would cause confusion and delay because of the different procedural and substantive requirements of the cases, and the fact that they name different defendants.
