Lead Plaintiff In Eli Lilly FLSA Suit Still Out

Law360, New York (October 1, 2010, 4:46 PM EDT) -- A federal judge has refused to reconsider her ruling that a former Eli Lilly and Co. pharmaceutical representative was exempt from overtime pay under the Fair Labor Standards Act, but also declined to decertify the collective action seeking overtime wages from the drugmaker.

Ruling for the U.S. District Court for the Southern District of Indiana on Wednesday, Judge Sarah Evans Barker denied Susan Schaefer-LaRose's motion for reconsideration and gave the remaining employees in the suit an opportunity to select a new lead plaintiff.
