DirecTech Can't Secure Judgment In OT Suit

Law360, New York (October 1, 2010, 3:21 PM EDT) -- A judge has denied a summary judgment bid by DirecTech Delaware Inc. in a putative collective action, rejecting the satellite TV equipment installer's claim that the plaintiffs weren't entitled to overtime pay because they were covered by the Fair Labor Standards Act's retail or service establishment exemption.

Judge George O'Toole of the U.S. District Court for the District of Massachusetts denied Directech's December 2009 summary judgment bid Thursday.
