Supreme Court Leaves Apex Liable For $150M Cleanup

Law360, New York (October 4, 2010, 6:11 PM EDT) -- The U.S. Supreme Court on Monday refused to take up Apex Oil Co. Inc.’s appeal of a decision that barred the company from evading vast environmental liability through the bankruptcy process.

The high court denied Apex’s petition for writ of certiorari, dashing the Apex's hope for a possible reprieve from an order requiring it to clean up $150 million in pollution from a refinery in Hartford, Ill., despite the fact that the company predecessor responsible for the contamination entered bankruptcy in 1987.
