Judge Won't Revisit Ruling Allowing Milk Antitrust Action

Law360, New York (October 4, 2010, 6:36 PM EDT) -- A federal judge has shot down a bid by Dean Foods Co. to reconsider her earlier ruling refusing to dismiss claims by a class of dairy farmers that the company and Dairy Farmers of America Inc. monopolized distribution of fluid milk in the Northeast.

Judge Christina Reiss of the U.S. District Court for the District of Vermont on Monday denied Dean Foods’ request that she revisit her Aug. 30 decision denying its motion to dismiss the plaintiffs’ complaint in its entirety.
