Allegheny's Post-Trial Bid To Nix CAA Suit Denied

Law360, New York (October 8, 2010, 4:55 PM EDT) -- A federal judge has rejected Allegheny Energy Inc.'s bid for judgment as a matter of law in a Clean Air Act suit brought by the Pennsylvania Department of Environmental Protection and four states over allegedly unapproved and emission-increasing changes the company made to its coal-fired power plants.

Judge Gary Lancaster of the U.S. District Court for the Western District of Pennsylvania signed off on an order denying the defendants' motion without prejudice Wednesday.
