Chevron's Malice Suit Against Ecuador Atty Nixed

Law360, New York (October 11, 2010, 1:55 PM EDT) -- A federal judge has tossed Chevron Corp.'s malicious prosecution suit against an attorney who had previously been sanctioned for not verifying cancer claims in a case alleging the oil giant dumped toxic waste in the Amazon rain forest.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California struck the remainder of the case under California's anti-Strategic Lawsuit Against Public Participation statute, which bars suits prompted by the exercise of free speech unless plaintiffs show a likelihood they will prevail.
