8th Circ. Affirms Preemption Ruling In Medtronic MDL

Law360, New York (October 15, 2010, 5:16 PM EDT) -- A divided federal appeals court has affirmed a lower court ruling dismissing product liability claims against Medtronic Inc.’s recalled Sprint Fidelis defibrillator leads as preempted by the U.S. Food and Drug Administration’s premarket approval process.

A three-judge panel of the U.S. Court of Appeals for the Eighth Circuit ruled Friday that the U.S. District Court for the District of Minnesota had correctly dismissed the consolidated complaint filed by more than 200 consumers who alleged the cardiac devices were unsafe.
