Lloyd's Can't Shake Hurricane Coverage Action

Law360, New York (October 19, 2010, 2:00 PM EDT) -- A federal judge has refused to throw out a putative class action alleging Lloyd’s of London property insurance policies conceal separate deductibles for hurricane damage in violation of Florida law.

On Monday, Judge Cecilia M. Altonaga of the U.S. District Court for the Southern District of Florida rejected certain underwriters’ contention that the latest complaint is barred. Policyholders claim that separate hurricane deductibles are void because the policies do not properly notify consumers of the different treatment for hurricane losses.
