Court To Rethink Enzo Patent Bid

Law360 (March 12, 2007, 12:00 AM EDT) -- A federal district court has ordered the Board of Patent Appeals and Interferences to take a second look at its decision that Enzo Therapeutics Inc. intentionally abandoned a patent application during an interference proceeding with an Israeli research and development firm.

The ruling, handed down by U.S. District Judge Robert Doumar on Feb. 28 but made public on March 1, reverses a decision of the Board of Patent Appeals and Interferences and remands the case back to the board for review.
