1st Circ. Affirms Liability Of Infomercial Producers

Law360, New York (October 22, 2010, 3:33 PM EDT) -- A federal appeals court has upheld the Federal Trade Commission's victory against infomercial producers accused of deceiving consumers by shilling dietary supplements as panaceas that could cure every disease from cancer to obesity.

The U.S. Court of Appeals for the First Circuit on Thursday affirmed a lower court's ruling that infomercial makers Direct Marketing Concepts Inc. and ITV Direct Inc. and their owners were liable for deceptive advertising, as well as a $48 million damages award against them.
