Class Cert. Denied In International Paper Enviro Battle

Law360, New York (October 22, 2010, 1:47 PM EDT) -- A federal judge has refused to certify a class in a case seeking to hold International Paper Co. liable for pollution near one of its paper mills in Alabama, saying it would be too difficult to determine who belonged in the class.

Judge W. Harold Albritton of the U.S. District Court for the Middle District of Alabama issued the ruling Wednesday, adding that the two named plaintiffs, James K. Benefield and Donald Ray Johnson, would be inappropriate class representatives.
