3rd Circ. Revives FTC Claim Against Supplement Maker

Law360, New York (October 26, 2010, 7:12 PM EDT) -- A federal appeals court has revived the Federal Trade Commission's motion to hold dietary supplement maker Lane Labs-USA Inc. in contempt for violating a consent judgment by deceptively advertising a calcium supplement and a fertility treatment.

The U.S. Court of Appeals for the Third Circuit ruled Tuesday that a lower court had “committed clear error” in denying the FTC's motion and remanded the case.
