Agfa Guilty Of Inequitable Conduct, Judge Rules

Law360, New York (August 25, 2004, 12:00 AM EDT) -- A federal judge has declared six Agfa Corp. patents unenforceable due to inequitable conduct, entering a judgment in favor of defendant Creo Inc. in a dispute over printing technology.

In a 50-page decision, Judge George A. O'Toole Jr. of the U.S. District Court for the District of Massachusetts said Agfa’s patent applications for a method for transferring computer content to a metal plate used in printing presses had knowingly and intentionally omitted references to key prior art.
