Fed. Circ. Won't Remand Patent Suit Against BofA

Law360, New York (October 29, 2010, 6:14 PM EDT) -- A federal appeals court has refused to remand Every Penny Counts Inc.’s suit challenging a district court’s decision invalidating its business method patent asserted against Bank of America Corp.

In a brief order, the U.S. Court of Appeals for the Federal Circuit on Thursday shot down a bid by EPC to send its suit back to the district court in light of the U.S. Supreme Court’s Bilski decision on patentable subject matter, agreeing with Bank of America to keep the matter before the appeals court....
