Plaintiffs' Atty Kicked Off Family Dollar Worker Suit

Law360, New York (November 2, 2010, 12:38 PM EDT) -- Workers suing Family Dollar Inc. for alleged wage-and-hour violations will have to find new counsel, now that a federal judge has ruled their lawyer's representation of store managers in a similar proposed class action presents “a number of potential practical ethical problems.”

Judge Charles R. Simpson III of the U.S. District Court for the Western District of Kentucky granted Family Dollar's motion to disqualify plaintiffs' counsel on Friday, noting that the retailer intends to call on the managers for its defense in the workers' action....
