Fla. Agency Told To Clarify Price-Gouging Law For Exxon

Law360, New York (November 2, 2010, 5:16 PM EDT) -- A Florida appeals court has ordered the state’s Department of Agriculture and Consumer Services to answer a petition by ExxonMobil Oil Corp. seeking clarification of a commodity pricing law under which the company could face state enforcement actions.

A three-judge panel of Florida’s First District Court of Appeal ruled Friday that the DACS wrongfully dismissed ExxonMobil’s petition, which asked the department to clarify the grounds on which the company could fend off a suit alleging violations of Florida’s price-gouging law.
