Trademark Owners Want AdWords Suit Revived

Law360, New York (November 3, 2010, 5:28 PM EDT) -- Five trademark owners have filed an amicus brief in federal appeals court, arguing that the lower court erroneously dismissed language-learning software maker Rosetta Stone Ltd.'s infringement suit against Google Inc.

The judge's dismissal makes it virtually impossible for trademark owners to sue search engines for infringement, regardless of the severity of the search engine's actions, the five companies said in a brief filed Monday in the U.S. Court of Appeals for the Fourth Circuit by Reed Smith LLP.
