Court Reverses Dismissal Of Truck Co.’s Antitrust Suit

Law360, New York (March 16, 2007, 12:00 AM EDT) -- An appeals court has overturned a lower court’s decision to dismiss a trucking company’s antitrust suit alleging its competitor, Werner Enterprises Inc., lured away its newly trained truck drivers.

On Thursday, the U.S. Appeals Court for the Ninth Circuit reversed and remanded a lower court’s decision that threw out CRST Van Expedited Inc.’s complaint accusing Werner of breaking California’s competition laws by soliciting and hiring away CRST truck drivers after the company had spent time and money training them.
