9th Circ. Won't Hear Appeal On FLSA Preemption

Law360, New York (November 4, 2010, 2:17 PM EDT) -- A federal appeals court has declined to hear an appeal brought by a Harrah's Las Vegas Inc. casino dealer who says her proposed state law wage-and-hour class action should not have been ruled preempted by her federal collective action claim under the Fair Labor Standards Act.

The U.S. Court of Appeals for the Ninth Circuit on Wednesday denied plaintiff Kimberley Daprizio's petition for permission to appeal the partial dismissal of her suit against Harrah's Las Vegas and Harrah's Entertainment Inc.
